1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and AppDataLayer ("Company", "we", "us", or "our"), concerning your access to and use of the AppDataLayer website and API services (the "Services"). You agree that by accessing the Services, you have read, understood, and agree to be bound by all of these Terms of Service.
If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Services and you must discontinue use immediately.
2. Subscription and Billing
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
By subscribing to our Services, you agree to pay all applicable fees and taxes. Subscription fees are billed in advance on a recurring basis (monthly or annually) depending on your selected plan. All payments are securely processed by Paddle, and their terms and conditions apply to your transactions.
3. Refund Policy
We offer a 14-day money-back guarantee from the date of your initial purchase. If you are not satisfied with our Services within this period, you may request a full refund by contacting us at support@appdatalayer.com.
After the 14-day period, all purchases are final and non-refundable, except as required by applicable law. If you cancel your subscription, you will retain access to the Services until the end of your current billing period. No partial refunds will be issued for the remaining billing period.
4. Acceptable Use Policy
You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:
- Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
- Circumvent, disable, or otherwise interfere with security-related features of the Services.
- Make improper use of our support services or submit false reports of abuse or misconduct.
- Use the Services in a manner inconsistent with any applicable laws or regulations.
- Share, resell, or redistribute your API key or access credentials to third parties without authorization.
5. API Usage and Rate Limits
Access to our API (including our Model Context Protocol server) is subject to rate limits depending on your subscription tier. We reserve the right to monitor your usage and temporarily suspend your access if you significantly exceed your allotted limits or if your usage degrades the performance of our Services for other users.
We may update rate limits and usage policies from time to time. Continued use of the Services after such changes constitutes acceptance of the updated limits.
6. Intellectual Property Rights
Unless otherwise indicated, the Services and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
The data retrieved through our API (app reviews, rankings, etc.) is publicly available information. We do not claim ownership of this data. However, our proprietary analysis, topic modeling, sentiment scores, and forecasting outputs are part of our Services and may not be redistributed as a competing service.
7. Account Termination
You may terminate your account at any time by contacting us at support@appdatalayer.com or through your account settings. Upon termination:
- Your subscription will be cancelled and you will not be charged further.
- You will retain access to the Services until the end of your current billing period.
- Your account data and API keys will be permanently deleted within 30 days of termination.
- You may request immediate deletion of all your personal data at any time.
We reserve the right to suspend or terminate your account without notice if we determine, in our sole discretion, that you have violated these Terms of Service.
8. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services, even if we have been advised of the possibility of such damages.
9. Disclaimer of Warranties
The Services are provided on an "as-is" and "as-available" basis. You agree that your use of the Services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Services, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties or representations about the accuracy or completeness of the data returned by our API.
10. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. We will provide notice of any material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending a notification to the email address associated with your account. Your continued use of the Services following the posting of revised Terms of Service means that you accept and agree to the changes.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Turkey, and the parties hereby consent to personal jurisdiction and venue therein.
